Crowdicity Community Rules

These community rules set out the terms under which you may access  and participate in any community of which Crowdicity forms part (“Crowdicity Community(s)”). “Crowdicity” is Crowdicity Limited’s web-based idea generation and innovation tool which allows online community based donation, collaboration, voting and market researching of new ideas. Crowdicity Communities generally form part of Crowdicity Limited’s website www.crowdicity.com (the “Site”) but may form part of other websites. These community rules  apply to all users of our Site and all Crowdicity Communities.

Your use of our Site and the Crowdicity Communities means that you accept, and agree to abide by, all the rules in these community rules, which supplement the Crowdicity Communities terms of use (and the documents referred to in them).

Further Information

Crowdicity, the Crowdicity Communities (other than any contributions made by any ideator and material owned by the community owner (where we are not the community owner)) and the Site are proprietary to Crowdicity Limited ("we", "us" or “our”).  We are registered in England and Wales under company number 07060991 and we have our registered office address at 340 Melton Road, Leicester, Leicestershire LE4 7SL. Our main trading address is at 88-90 North Sherwood Street, Nottingham NG1 4EE. Our VAT number is 984573469.

Each Crowdicity Community is operated by its community owner (“Community Owner”). The Community Owner may be Crowdicity Limited or a customer of Crowdicity Limited. Where the Community Owner is a customer of Crowdicity Limited, the Crowdicity Community concerned will give certain information about the Community Owner, such as their full legal name, their county of registration (if they are a company), their company number (or any similar registration number), their registered office address (if they have one) and their main trading address. Their VAT registration number may also be given if they are a UK organisation and have registered for VAT. Where the Community Owner is Crowdicity Limited, this information is given in the paragraph above.

Prohibited uses

You may use our Site and the Crowdicity Communities for lawful purposes. You may not use our Site and the Crowdicity Communities:

  1. in any way that breaches any applicable local, national or international law or regulation;
  2. in any way that is unlawful or fraudulent, or has any unlawful or fraudulent purpose or effect;
  3. for the purpose of harming or attempting to harm minors in any way;
  4. to send, knowingly receive, upload, download, use or re-use any material which does not comply with our content standards;
  5. to transmit, or procure the sending of, any unsolicited or unauthorised advertising or promotional material or any other form of similar solicitation (spam);
  6. to knowingly transmit any data, send or upload any material that contains viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware or any other harmful programs or similar computer code designed to adversely affect the operation of any computer software or hardware; and
  7. any purpose other than the purpose of the Crowdicity Community in relation to which the contribution was made.

You also agree:

  1. not to reproduce, duplicate, copy or re-sell any part of our Site or the Crowdicity Communities in contravention of the provisions of our terms of website use;
  2. not to access without authority, interfere with, damage or disrupt:
  1. any part of our Site or the Crowdicity Communities;
  2. any equipment or network on which our Site or the Crowdicity Communities are stored;
  3. any software used in the provision of our Site or the Crowdicity Communities; or
  4. any equipment or network or software owned or used by any third party.

Content standards

These content standards apply to any and all material which you contribute to the Crowdicity Communities  ("contributions"), and to any interactive services associated with them.

You must comply with the spirit of the following standards as well as the letter. The standards apply to each part of any contribution as well as to its whole.

Contributions must:

  1. be accurate (where they state facts);
  2. be genuinely held (where they state opinions);
  3. comply with applicable law in the UK and in any country from which they are posted; and
  4. be relevant to the purpose of the Crowdicity Community in relation to which the contribution was made.

Contributions must not:

  1. have an intent of provoking other users or of otherwise disrupting normal on-topic discussion;
  2. contain any material which is defamatory of any person (in these community rules, “person” means an individual, corporate or unincorporated body (whether having separate legal personality or not);
  3. contain any material which is obscene, offensive, hateful or inflammatory;
  4. promote sexually explicit material;
  5. promote violence;
  6. promote discrimination based on race, sex, religion, nationality, disability, sexual orientation or age;
  7. infringe any copyright, database right or trade mark of any other person;
  8. be likely to deceive any person;
  9. be made in breach of any legal duty owed to a third party, such as a contractual duty or a duty of confidence;
  10. promote any illegal activity;
  11. be threatening, abuse or invade another’s privacy, or cause annoyance, inconvenience or needless anxiety;
  12. be likely to harass, upset, embarrass, alarm or annoy any other person;
  13. be used to impersonate any person, or to misrepresent your identity or affiliation with any person;
  14. give the impression that they emanate from us, if this is not the case; or
  15. advocate, promote or assist any unlawful act such as (by way of example only) copyright infringement or computer misuse.

Suspension and termination

When we or the Community Owner determine, at our respective discretion, that there has been a breach of these community rules through your use of the Crowdicity Community concerned we or the Communitiy Owner may take such action as we deem appropriate.  

Failure to comply with these community rules constitutes a material breach of these community rules and the Crowdicity Community terms of use upon which you are permitted to use the Crowdicity Communities, and may result in all or any of the following actions:

  1. immediate, temporary or permanent withdrawal of your right to use the Crowdicity Communities;
  2. immediate, temporary or permanent removal of any posting or material uploaded by you to the Crowdicity Communities;
  3. issue of a warning to you;
  4. legal proceedings against you for reimbursement of all costs on an indemnity basis (including, but not limited to, reasonable administrative and legal costs) resulting from the breach;
  5. further legal action against you; or
  6. disclosure of such information to law enforcement authorities as we reasonably feel is necessary.

We and the Community Owner exclude liability for actions taken in response to breaches of these community rules. The responses described in these community rules are not limited, and any other action as reasonably deemed appropriate may also be taken.

Changes to these community rules

These community rules may be revised at any time by amending this page. You are expected to check this page from time to time to take notice of any changes that are made, as they are legally binding on you. Some of the provisions contained in these community rules may also be superseded by provisions or notices published elsewhere on the Crowdicity Communities.
